An Eye for an Eye; A Kidney for a Million Five
Richard Batista, a 49 year old doctor from New York is suing his 44 year old ex-wife, Dawnlle. Batista donated one of his kidneys to her in 2001. After his life saving donation, Dawnlle had an affair, ended the marriage and tried to get custody of their children. Batista now wants either $1.5 million dollars or the return of his kidney.
This poses some interesting questions. This man willingly gave a vital organ in his successful effort to save the life of his dying wife. Now, they are divorced due to her own deceitful and dishonest behavior.
Would the husband have provided the life saving organ had he known she would have been unfaithful and ended the marriage? Obviously the courts will not force her to return the kidney, but will they, or should they, make her pay? If so, how is the value of the kidney determined?
